- PAYMENT
Domestic Sales Terms: New Domestic accounts are
typically set up on Credit Card terms (we accept Visa and
MasterCard.) For existing COD customers we use a check guarantee
service for all COD Company Check shipments. If we are unable to
get an approval on your company check order, you will be given
the option to pay by Visa/MasterCard or COD Cashier Check.
Orders over $10,000 must be prepaid by wire transfer.
- International Sales Terms: WE DO NOT ACCEPT INTERNATIONAL OR CANADIAN
ORDERS AT THIS TIME.
- Credit Cards: We only accept verified Discover,
MasterCard and Visa. All credit card sales must be shipped to the billing address
of the credit card. NO EXCEPTIONS.
- PRICE PROTECTION OR STOCK ROTATION
Memorytek DOES NOT offer any type of price protection or stock
rotation. Our prices may change frequently and without notice.
- PRODUCT & AVAILABILITY
Due to high volume transactions, MemoryTek does not guaranty that a certain
product will be available for immediate shipment. In some cases, the product
may be out of stock. To verify availability, especially on large orders, call us at (510) 657-9991 or email weborders@memorytek.com.
Products listed are used/pulls unless otherwise noted. Products are tested prior to shipping.
- SHIPMENT
Flat Rate UPS Shipping Offer: All orders shipping within the continental United Stated (excluding Alaska and Hawaii) qualify for this offer. These orders are shipped via UPS ground Flat rate $5.00. If you desire another shipping option, you may select it, and the cost of the selected shipping option will be added to your order.
International Shipments: No International Shipping at this time.
Truck Shipments: If no other method of shipment is specified, MemoryTek will ship via the cheapest qualified carrier. This may not be the cheapest method of shipping. If this is a concern, be sure to specify how you want an order shipped. (We use only reputable national carriers).
You Pay Shipping Charges: When you place an order,
after you get to the final confirmation page, we will immediately
email you a confirmation of your order. Should you discover any
errors, please contact us immediately. Freight charges may be
blank on the confirmation. Once freight charges are calculated
and the order has shipped we will email you again with shipping
charges and tracking numbers.
Refused Shipments: If a shipment is refused for
any reason, customer is responsible for the freight charge incurred.
Memorytek also reserves the right to charge a 15% restocking fee
(if we choose not to waive).
- TAXES
Unless otherwise stated on the face hereof, stated prices do not
include any customs duties, sales, use, value added, excise, federal,
state, local or other taxes. All such duties or taxes shall be
paid by customer, or, in lieu thereof, customer shall provide
MemoryTek with an appropriate tax exemption certificate.
- TITLE AND RISK OF LOSS
Title to and risk of loss on all products passes from MemoryTek
to customer upon shipment from our facility. MemoryTek's liability
for delivery shall cease, and title and all risk of loss or damage
shall pass to customer upon delivery to carrier.
- WARRANTY INFORMATION
Warranty &Limitations: Our products are backed with a 90 day warranty. However, MemoryTek cannot warrant an item that has been improperly used or physically damaged.
Manufacturer Direct Warranties: If there is a Manufacturer Direct Warranty, we require that you return the unit direct to Manufacturer, unless the unit was DOA (within 7 days after receipt).
- RETURN PROCEDURES
Customer must first obtain a Return Merchandise Authorization
(RMA) number by calling us at 510-657-9991 or email us at webrma@memorytek.com.
Please specify your order number, item or items that need an RMA,
and a description of the defect or reason for exchange or refund.
A Return Merchandise Authorization (RMA) is required for returning
or exchanging. RMA numbers are valid for 14 days from date of
issuance. Please ensure that the RMA number is visible on your
return packing label. Any return or exchange without the RMA number
will NOT be accepted. MemoryTek reserves the right to refuse any
return due to expired RMA number, no RMA number on shipping label
or incomplete items including anti-static packaging.
For your protection, we recommend you fully insure your return
shipment in case it is lost or damaged and use a carrier that
can provide you with proof of delivery and tracking number. Recommended
carriers include UPS and Federal Express. All items must be 100%
complete and in "good as new" conditions. Returned item(s) must
be returned in anti-static bag and in the original packaging(BOX). If you
don't follow this PROCEDURE and product comes back damage/unusabe
you will not be given credit/exchange, unless you have insured the
package.
If product arrives damaged, save the product and the original
packaging, notify MemoryTek's Customer Service immediately to
arrange for a carrier inspection and a pick-up of damaged merchandise.
Shipping and insurance charges are not refundable. Even though
we are currently running a "Flat Rate Shipping" promotion, items returned
for a refund will have MemoryTek.com's original shipping cost
deducted from the amount of the refund. All Refunds will only be credited to the same credit
card.

- ENTIRE AGREEMENT
These terms and conditions, including those on the face hereof,
constitute the entire agreement with regard to this sale and expressly
supersede and replace any prior or contemporaneous agreements,
whether written or oral, relating to said sale, including any
terms and conditions on any of customer's documents or purchase
orders. This agreement shall be binding upon the heirs, successors
and assigns of the parties hereto. If any provision of this agreement
shall be held to be invalid or unenforceable, the remainder of
this agreement shall remain in full force and effect.
- GOVERNING LAW, JURISDICTIN AND COSTS
This agreement is governed by the laws of the State of Missouri,
without regard to its conflict or choice of law provisions. Customer
acknowledges and agrees that Missouri is an appropriate place
for venue of any litigation and that Missouri courts have jurisdiction
over this agreement and customer.
Any dispute arising under this agreement shall be resolved by
binding arbitration in the city of Missouri and under the rules
of the American Arbitration Association.
- TERMS AND CONDITIONS
This sale is subject to the terms and conditions stated herein,
which are in lieu of and replace any and all terms and conditions
set forth in any documents issued by customer, including, without
limitation, purchase orders and specifications. In case of conflict
between the terms and conditions stated here and those on the
face hereof, those on the face hereof shall control. Any additional,
different or conflicting terms and conditions on any such document
issued by customer at any time are hereby objected to by MemoryTek,
and any such document shall be wholly inapplicable to any sale
made here under and shall not be binding in any way on MemoyTek.
